These Terms & Conditions ("Terms") govern your use of our website, tools, software, documents, and services — including the Estate Danger Score™, SuperWill™, EstateGuard™, HeirShield™, Estate Risk Coach™, Estate Risk Management™ (Boedel Risiko Bestuur™), and related estate planning technologies (collectively, the "EstateWatch System").

By accessing or using our platform, you agree to be bound by these Terms.

1. Intellectual Property Ownership

All content, systems, scoring models, clause libraries, templates, methodologies, and product names on this site are the exclusive intellectual property of Boedelbeskermers Holdings (Pty) Ltd ("the Company") under exclusive international license from EstateWatch LLC.

This includes, but is not limited to:

• Estate Danger Score™
• SuperWill™ (and all editions)
• EstateWatch™ platform, Vault, and Locker™
• HeirShield™, EstateGuard™, and CreditorShield™
• Estate Risk Coach™
• Estate Risk Management™ (Boedel Risiko Bestuur™)
• Legacy Forecast™, Living L&D Account™, Lexi™ AI, and future modules

This ownership extends to all derivative works, enhancements, adaptations, visual design, software code, database structures, and any future systems developed under the EstateWatch™ brand.

All rights are reserved under South African copyright and trademark law, U.S. law, and international treaties.

2. Use of Content and Tools

Users and advisors are granted a limited, non-exclusive, non-transferable license to use the EstateWatch™ System solely for:

• Personal estate planning, or
• Advisory use as an officially licensed EstateWatch™ advisor.

You may not:

• Reverse engineer, copy, reproduce, or replicate any part of the system
• Train others to duplicate our methodology, scoring systems, or frameworks
• Use EstateWatch content in competing platforms, products, or services
• Scrape, harvest, or use automated tools (including AI or machine learning systems) to replicate, train on, or derive competing models from EstateWatch™ content or tools
• Resell, redistribute, or commercially exploit any materials without prior written consent
  
  

3. Advisor License Agreements

Advisors using the EstateWatch™ System must agree to and sign a separate Advisor License Agreement. All tools provided under license remain the sole property of Boedelbeskermers Holdings (Pty) Ltd and its licensors.

Unauthorized advisor use will immediately terminate the license and may result in claims for damages, liquidated damages, and injunctive relief.

4. Legal Relationship & IP Rights

Boedelbeskermers Holdings (Pty) Ltd operates under exclusive license in South Africa from EstateWatch LLC, a Delaware-registered international holding company (final registration and IP filings in progress).

EstateWatch LLC is the ultimate owner of all intellectual property rights to:

• The EstateWatch™ brand and system
• Estate Risk Management™ (Boedel Risiko Bestuur™) methodologies
• Digital scoring engines
• Clause libraries and legal logic
• SuperWill™ framework and derivative tools
• Vault™, Locker™, AI systems, and future product enhancements

Unauthorized use or replication of EstateWatch™ IP — locally or internationally — is strictly prohibited and will be prosecuted.

5. Legal Costs, Damages, and IP Enforcement

Any individual, advisor, or organization that infringes, attempts to infringe, or facilitates the infringement of EstateWatch™ intellectual property, systems, frameworks, or processes shall be liable for:

• All legal fees, attorney costs, investigation expenses, and protective actions taken by the Company, whether or not formal legal proceedings have commenced
• Immediate injunctive relief (court order to cease use) in any competent jurisdiction
• Liquidated damages of R250,000 (or USD $25,000) per violation, as a genuine pre-estimate of harm caused, in addition to any other damages recoverable at law

This applies to, but is not limited to:

• Unauthorized copying, reverse engineering, or distribution of content
• Use of EstateWatch™ materials in competing services
• Training of AI systems on EstateWatch™ materials
• Replication of frameworks, scoring models, clause libraries, or branding
  
  

6. Cybersecurity & Fraud Warning

EstateWatch™ is committed to protecting users from digital fraud and cybercrime. We will never ask for sensitive financial information (such as bank account or credit card details) via email, SMS, or third-party messaging platforms.

All payments, account updates, and estate matters will always be managed either:

• Through our secure online platform, or
• Through a direct conversation with your assigned EstateWatch™ licensed advisor or verified EstateWatch™ admin staff.

Any requests outside of these channels should be considered suspicious and reported immediately to info@estatewatch.co.za or +27 76 878 6069.

EstateWatch™ shall not be liable for losses incurred due to user negligence, including but not limited to disclosure of login credentials, failure to verify communications, or responding to fraudulent requests outside approved channels.

7. Termination

The Company reserves the right to suspend or terminate access to the platform at any time for any breach of these Terms.

8. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any dispute shall be subject to the exclusive jurisdiction of South African courts.

For international users, EstateWatch LLC may enforce intellectual property rights under U.S. law and international treaties, in addition to South African law.
